Kentucky clerk openly defies Supreme Court

A day after the Supreme Court denied her stay (her lawyers asked the court to rule on her contention that it is a violation of her religious freedoms to issue marriage licenses to same-sex couples), the clerk continued to refuse to issue the licenses. She contends that God has a higher authority than the Supreme Court. Well, quite likely He does on many things, but not the laws of the United States.

The entire legal system has bent over backward being patient with this bitch. Time to get serious.

What are the options?

Well, she meets back with the first federal judge to rule against her on Thursday. Since there is no reason for the judge to give her more time (there are no more appeals possible), it is almost certain that the judge will order her to provide the licenses or be held in contempt -- meaning fined and/or jailed.

Gay rights activists don't want Mrs. Davis jailed, afraid that would make her a martyr for the religious right, and would prefer that she be so heavily fined that she has no choice. I seriously doubt a fine only will work, as we know well that the right will immediately dump tons of money on her to pay her fine.

So, if the court doesn't have the stomach to jail her ...

The next step would be impeachment, but would politicians in Kentucky, a reddish state, be brave enough to do it? I don't know. Maybe the U.S. government will have to send in the troops :)

BTW, one of the ironies of this situation is that Mrs. Davis, the country's symbol for defending the sanctity of marriage, is on her FOURTH marriage!!! So much for the sanctity of marriage.

Frankly, I think just punishing Mrs. Davis isn't enough in this case. She has been horribly represented by the Liberty Counsel, the conservative troublemaking legal group, so much so that I think if she sustains considerable damage, she could probably sue them for misrepresentation.

Liberty Counsel is only interested in this case as a fundraising tool and to improve their brand with their religious right customer base. The lawyers involved in this case, if they are advising her to defy the Supreme Court, should also be fined and even disbarred!!!!

This fool's 15 minutes are already long past. Time to shut her up and down.

  • Now, if the clerks under Ms. Davis's continue to do their job and issue marriage and other licences in accordance with the law her office will be rendered irrelevant. ‘Old soldiers never die. They just fade away.’ That strikes true for “...Christian soldiers! Marching as to war...” I hope that the issue simply withers and fades. I’m sure there is a position waiting for Ms. Davis at Hobby Lobby.

  • Well, our anti-gay little county clerk got out of jail Tuesday, but hinted that she still won't obey the court. It could be quite awhile before that is put to the test, however, as I imagine that the gay couples in Rowan County who wanted a marriage license got one while she was in jail. I suppose it's possible that gay groups may have talked one couple into holding off to put her to the test again, but if not, no telling how long it will be before it comes up again.

  • Also remember it wasn't but a few months ago that a church of Satan wanted to erect a statue at a courthouse. To prevent them from having an argument the courthouse decided to remove the ten commandments and other religious items from their grounds.

    Freedom of religion is an umbrella that gives freedom to ALL religious beliefs not just mine and not just Christian right wing nuts.

    Also the religious freedom on the job thing is a silly argument. For instance I'm not a fan of abortion and believe it is wrong. Would it make sense for me to take a job at an abortion clinic then refuse to perform the abortion?

    Also I believe the statue was supposed to be a bronze rendering of belphamet not sure

  • Yes, they are opening a big can of worms. Just this week, a Muslim stewardess sued because she was fired for refusing to serve alcoholic beverages during flights. I don't think religious beliefs are a legitimate excuse for refusing to do your job. If you believe that strongly, you should find another line of work.

  • Religious freedom, Kim Davis and the religious right should be careful of what they ask for. Their same argument could be used by a government official, a pacifist or Quaker, to refuse to issue gun licences. An interesting perspective in Clarence Page's editorial in the Sunday Chicago Trib.

  • Justice finally prevails in Rowan County. With Kim Davis safely behind bars, the first same-sex couple picked up their license Friday.

    Davis could have been released if she had agreed to let her clerks distribute the licenses, but she refuses to agree. So in jail she stays. She can stay there till hell freezes over as far as I'm concerned.

  • The best part in this was that she was given numerous opportunity to avoid jail and chose jail anyway.

    Also I didn't realize that she wasn't just refusing to issue licences but also prevented the other clerks from doing their job

  • The icing on the cake? I bet she thought she could get some sympathy money off crowdfunded sites, like Zimmerman, the anti-gay bakery, etc have done in the past. However, GoFundMe, which is one of the biggest players in the field, has enforced a rule since April that they won't allow raising funds for people who are facing conviction charges and hatemongers.

    Sure, there are other sites like Kickstarter or Indiegogo which *might* still host fundraisers, but at the moment, all I see on Indiegogo are one "Super Gay Makeover for Kim Davis" fundraiser ($20 raised https://www.indiegogo.com/projects/super-gay-make … vis#/story ) and a seemingly legitimate "KIM DAVIS LEGAL DEFENSE FOUNDATION", which is still at $0 after 17 hours (which is not a lot of time, but the poor response is encouraging!)

  • Wise move by the judge to throw her in jail. He, rightly, knew that a fine was pointless. Still, though, I'm a bit surprised he had the balls to throw an older woman in jail.

    She may last a few days, but I can't see it going on too long. OTOH, she may be a tough old bird :)

  • I am waiting for a good team of lawyers to take on the idea that you can claim that the bible is somehow a rule of law? If I enter into a contract I have to obey the entire contract and not just parts of it or I am in violation of the contract. Why do we allow religious believers to pick and choose what they want to follow and not follow and not the entire bible? Which bible, what version, who actually wrote it and when? Where do we stop with religious beliefs? The problem is that many of these people who believe in the fairy tale also believe that the world is about to end so they are not interested in obeying laws because soon they are going to be swept up in the last chapter of the fairy tale and everything is going to be "Happy ever after Time".

  • I imagine that eventually the Supreme Court is going to take one of these religious freedom vs. same-sex marriage cases. But in this particular case, it's pretty clear that at least 6 members of the court feel that government officials/employees have to do their job regardless of their religious beliefs. The court would be more likely to accept something like one of the cake-baking cases.

    Fenway: I imagine others are waiting to see how her case plays out. I'm sure there are a lot of small counties in the country where no gay couples have even asked for marriage licenses. I read somewhere that the gov is weighing whether to intervene, but he's up for re-election .....

  • Confused to why the Governor hasn't stepped in. I was also wondering why she's the only one in that office that can issue licences, but realized the others in the office are encouraging and egging her on. I'm also amazed that she's the only one in the country that's pulling a stunt like this. So many questions, so little time.

  • I usually don't follow these stories to often because I know the inevetible outcome. But this has really struck a chord for me I'm both gay and Christian believer.

    Her views on the subject like most Christians are twisted by a long history of religious politics and power grabbing individuals. The message of Jesus is of love hope and redemption but they choose to turn people away. It makes me sick to think she's invoking the name of God for her personal gain. God isn't on her side with this.

    Question why hasn't she been impeached yet?

    Also even if the right wing nuts dump a ton of money on her wouldn't there still be benefits of fining her with increasing fines? Double cost every day she holds out??

    And think of how week we must look to the world or how flawed we must look. Our government can't inforce the laws it passes? This hole situation has really messed me up

  • This woman has no intention of following her "religious beliefs". Dan Savage tore her up on MSNBC last night and called it as it is. She wants to get fired to become a martyr. She never wants to work a day again in her life and wants to travel the religious circuit speaking, toting the religious right rhetoric and getting paid. Then the book, then the movie etc. What the judge has to do is fine her, let it double every day, till she can't afford to keep her job and has to quit so it looks like she did it for less than pious reasons and more of financial reasons. She's totally trying to cash in on a good thing. If she is such a person of holey values she would not be on her 4 marriage and had her twins out of wedlock.

  • Anyone in Kentucky could institute the recall. She took an oath of office and in that oath she swears to uphold the US Constitution and also the Kentucky Constitution so she is in violation of her oath of office and should be recalled. Too many times we expect others to fight our battles but in this case anyone living in Kentucky could get this ball rolling. She is not the target but the poor soul in the middle but like all wars there are lots of unintended victims.

  • Sounds like a lawsuit is in order. When you pay taxes for services and they are not delivered by an unwilling clerk. I'm sure some lawyer is chomping at the bit to get the call to action on this.
